‘Private layouts should have sites for processing garbage’

High Court issues direction to BDA in this regard

From now on, the Bangalore Development Authority (BDA) will have to ensure that a separate site is earmarked in all the private layouts for solid waste management (SWM) for processing garbage generating in that layout.

The Karnataka High Court on Monday issued a direction in this regard to the BDA when it was brought to its notice that civic amenities sites could also be used for garbage facilities as the State government, back in 1990, had included “garbage facility” as one of the public utilities for which civic amenities sites could be used for.

A Division Bench comprising Justice N. Kumar and Justice B.V. Nagarathna passed the order while hearing PIL petitions about the garbage problem in the city.

The court asked the BDA to ensure that all the private layouts, for which plans have been sanctioned but not yet formed, earmarked a site for SWM. Meanwhile, the BDA informed the court that 429 acres 17.5 guntas of land at 11 locations in the city had been identified and reserved for public utilities — which include water and garbage facilities— in the Revised Master Plan-2015, which came into force in June 2007.

Haralakunte, Hongasandra, Kachohalli, Machohalli, Seegehalli, Kodigehalli, Kannenahalli, Mavallipura, Chennenahalli, Yelachaguppe and Bilvaradahalli are the villages where the lands have been earmarked, the BDA stated in its statement besides indicating that there were about 40 civic amenities sites in the East, West, South and North zones of the city that could be utilised for SWM by the BBMP.

The BDA said that an area of 39,086 sq m had been allotted to BBMP at Banashankari 6th Phase, 5th Block for public purpose.

Meanwhile, senior advocate Pramila Nesargi, who impleaded herself in the case, submitted a CD with details of a water-based solid waste segregation system, adopted in Israel by a firm called Arrow Bio, indicating that this system could be used in Bangalore city.
