Bruhat Bangalore Mahanagar Palike (BBMP) councillor B.S. Satyanarayana of Basavanagudi ward on Tuesday moved the High Court of Karnataka questioning its order of directing the government to hold elections to the posts of Mayor and Deputy Mayor only if it reserved the posts for Scheduled Tribes category.
A Division Bench, comprising Chief Justice D.H. Waghela and Justice B.V. Nagarathna, before whom the appeal came up for hearing, said that it would take up the plea along with an appeal stated to have been filed by the State government challenging an April 19 interim order.
Meanwhile, the Division Bench told counsel for Mr. Satyanarayana that it would be better if he (Satyanarayana) exercised the option of seeking a review of the previous order by impleading in that case as he was not a party before that Bench.
The petitioner has contended that the order was passed without application of mind as the litigation pertained to the 2012 elections to these posts and the government reserved the post of Mayor for general category in February 2013 and that it had not brought these aspects to the notice of the single judge Bench.
