Hotel's plea on khata allowed

The Karnataka High Court on Monday allowed the plea of Gstaad Hotel Private Limited, which has been constructing a 20-storey, five-star hotel at UB City on Kasturba Road here, challenging Bruhat Bangalore Mahanagara Palike's decision to bifurcate the khata of the land on which the building is constructed.

The land comprises two portions, one having a larger dimension and another smaller one, divided by a storm-water drain. The BBMP had permitted the firm to construct the hotel building, treating both parcel of lands on either side of the drain as one under single khata number. However, in the recent past the BBMP allotted two khata numbers to the land. This had affected the firm as bifurcation of khata reduced floor area ratio, which empowers the BBMP to demolish certain floors of the hotel building. The firm alleged that the decision to allot two khatas was with a malafide intention.

The firm's director, Aditya Raheja, had on March 29 filed a police complaint against the area councillor Shivakumar. The police had arrested Mr. Shivakumar. A Division Bench comprising Chief Justice Vikramajit Sen and Justice B.V. Nagarathna allowed the plea.
