HC: Vyalikaval society can retain land for now

The Karnataka High Court on Tuesday quashed the government order cancelling allotment of 165 acre 30 guntas to the Vyalikaval House Building Cooperative Society for its Nagawara Layout project. Justice Anand Byrareddy passed the order while allowing petitions filed by the society, some members who were allotted sites in the layout and some others who had subsequently purchased sites from the members.

The High Court said that the government’s orders are pre-mature as the issue pertaining to land acquisition is pending before the Supreme Court, which is yet to give its ruling. In June 2013, the government had issued an order cancelling acquisition of the land based on an opinion given by the Law Department.

The land had been acquired in 1984.
