HC restrains real estate developers

PIL alleges that officials violated rules in granting permission for extraneous considerations.

The Karnataka High Court on Tuesday directed three prominent real estate developers not to create third party rights in their under-construction multi-storey residential apartment complexes in various survey numbers of Begur village on Begur-Hulivamu Road.

A Division Bench comprising Acting Chief Justice Subhro Kamal Mukherjee and Justice B.V. Nagarathna passed the interim order on a PIL petition, filed by Anil Aggarwal, complaining that various authorities had allegedly violated rules in granting permission for extraneous considerations. The court has also ordered a status quo on the nature and characteristic of the properties.

Annabel Builders and Developers Pvt. Ltd. and DLF Southern Homes Pvt. Ltd., and Saudela Constructions Pvt. Ltd. were putting up 30-storey apartment complexes.

It has been alleged in the petition that top bureaucrats of Bruhat Bengaluru Mahanagara Palike (BBMP) and the Bangalore Development Authority (BDA) had in 2010 sanctioned plans in violation of zonal regulations.

The petitioner claimed that officials tried to widen the road to 24 metres on a 850-metre stretch of the three-km-long road in violation of zoning regulations to favour the developers as the road width is only 9.1 metres and initially, the plans were sanctioned only for ground plus four floors.

The petitioner pointed out that a criminal case, registered by Bangalore Metropolitan Task Force, against some top officials and some developers, was quashed by the High Court in February 2015 for technical reasons but giving liberty for initiating fresh action. However, no action had been taken so far.
