Bengaluru: The Karnataka High Court has ordered issue of notices to the Bruhat Bangalore Mahanagara Palike (BBMP) and HMT ward councillor Asha Suresh on a PIL petition seeking a direction to the civic body to prohibit her from attending the council meetings in view of her alleged resignation in December 2015.
A Division Bench comprising Chief Justice Subhro Kamal Mukherjee and Justice Budihal R.B passed the order on a petition filed by N. Nanjundappa.
The petitioner had pointed out that Ms. Asha had submitted her resignation on December 31, 2015 during a meeting of the council while alleging harassment by M. Munirathna Naidu, the MLA of Rajarajeshwari Nagar Assembly constituency, as was widely reported in the media.
It was contended in the petition that Ms. Asha could not have been allowed to participate in the council meetings as the resignation would come into effect soon after submission of the resignation letter. Under Section 8(5) of the the Karnataka Municipal Corporation Act, the law has no provision for acceptance or rejection of resignation.
The petitioner claimed that the BBMP is illegally allowing her to attend the meetings.
