The Karnataka High Court on Tuesday disposed of a public interest litigation (PIL) petition challenging the acquisition of land within Lalbagh for construction of a station for Namma Metro.
A Division Bench comprising Chief Justice J.S. Khehar and Justice A.S. Bopanna disposed of the PIL petition by Environment Support Group (ESG) and others after directing the State Government and the authorities to implement Section 14 of the Karnataka Town and Country Planning Act.
The Bench made the suggestion after the petitioners said there had been no public debate on the issue of a station for Namma Metro within the botanical garden.
The Bench orally observed that since a lot of money had already gone into the project and the Lalbagh station was almost complete, it could do nothing now.
However, it suggested to the State to ensure that the provisions of Section are strictly adhered to and any change in any alignment of a project or acquisition is published well in advance so that people have the opportunity to look into it and file objections.
The Bench then disposed of the petition.
