The Karnataka High Court on Wednesday quashed the formation of Tumkur City Corporation stating that the city lacks requisite population to be declared a city corporation as per the law.
Justice B.V. Nagarathna passed the order while allowing a petition filed by Azim Pasha, a councillor of erstwhile Tumkur Municipal Council.
It is for the first time in the recent years, the formation of a city corporation by the State Government has been struck down by the court.
The High Court found that the declared population of Tumkur is less than three lakh as per Census 2001.
KMC Act
As per Section 3 of the Karnataka Municipal Corporations (KMC) Act 1976 it is mandatory that the population of the area, to be declared as a corporation, should be not less than three lakh.
The population of Tumkur was about 2.48 lakh as per the Census 2001 and the State Government had declared it as a city corporation assuming that the presentpopulation exceeds three lakh.
Even though the High Court quashed the Government notification issued on August 25, 2010 declaring the formation of Tumkur City Corporation, the court gave liberty to the Government to issue fresh notification if the population of Tumkur exceeded three lakh as per Census 2011.
