The High Court of Karnataka on Tuesday allowed the State government to provide 8 per cent reservation for students from Hyderabad Karnataka region in government-quota medical seats in private unaided medical colleges which sign the consensual agreement on seat sharing with the government.
Modified
A vacation Division Bench comprising Justice B. Veerappa and Justice P.S. Dinesh Kumar passed the order while modifying the earlier interim order passed in July last year staying the operation of the Karnataka Private Unaided Educational Institutions (Regulation of admission in Hyderabad-Karnataka Region) Order, 2013. The court, however, said the government could implement the 8 per cent reservation within its quota only in those private unaided medical colleges with which it signs consensual agreements for admission of students under the government quota and not other unaided private medical colleges.
This order will also help the government to earmark 8 per cent of the total seats in all the government medical colleges for students of Hyderabad Karnataka region.
The Bench modified the order after hearing State Advocate-General Ravivarma Kumar who pointed out that private unaided medical colleges were against enforcement of the 8 per cent reservation for their quota of seats and not the seats that would be filled up under the government quota.
Counsel for the association of private professional colleges too agreed on this point.
2013 order
The provision for 8 per cent reservation was made under the order, issued on November 6, 2013, after special status was granted to the Hyderabad Karnataka region by amending Article 371J of the Constitution.
