Petitioner seeks probe into construction of private building

The Karnataka High Court has ordered issue of notice to the State on a PIL petition seeking probe by an independent agency into the use of a civic amenity site, measuring around 20,000 sq. ft. and situated in a private layout, for construction of an apartment complex.

A Division Bench comprising Chief Justice Subhro Kamal Mukherjee and Justice Budihal R.B. passed the order on a petition filed by Shekhar N.P., who has also sought a direction for restoring the site for civic amenities for the benefit of residents of the layout.

The petition alleges that the developer and others have obtained khata and a licence for constructing a private building even though the plot was earmarked for civic amenities by the developer of the layout in survey numbers 23 and 25 of Mylasandra near Kengeri.

The petitioner claims that the Bruhat Bangalore Mahanagara Palike has not initiated any action against the developer despite a representation submitted by him on a direction given by the court earlier.
