TDP leader files ‘implead’ petition in the court

Telugu Desam Party (TDP) urban president Vallabhaneni Vasmimohan has filed a petition in the High Court urging it to vacate the stay on release of water to the Krishna delta.

Thanikonda Chiranjeevi, counsel for Mr.Vamsi, said that two petitions—252/2012 and 261/2012 — had been filed in the High Court opposing release of water to the delta. The government, however, had not filed a counter-affidavit so far. The TDP leader filed the “implead” petition urging the court to vacate the interim orders dated July 25, 2012, in the public interest litigation No.261 of 2012 and July 16, 2012, in the PIL No.252 of 2012, he said, adding that the case would come up before High Court Chief Justice Chandra Gosh on Monday.

The TDP leader, in the petition, said the 252 and 261 “PILs were not maintainable either in law or on facts. Release of water from the river for drinking water and irrigation purpose is purely an administrative and technical function of the government. Any decision in this regard has to be taken purely on the technical feasibility and administrative expediency in the public interest.”

“There is no statute or any other law regulating this function and, therefore, there is no justifiable cause to file the PIL.

The decision of the government to release water to the Krishna delta which has geared up for transplantation of paddy from seed beds already raised is in public interest,” he said.

The importance of the Krishna delta canal system and its requirements were well appreciated both by the Second Krishna River Water Disputes Tribunal chaired by Justice Brijesh Kumar, and the earlier Bachawat Tribunal.

The Krishna delta consisted of 66 mandals of Prakasam, Guntur, krishna and West Godavari districts having a cultivated area of 13.09 lakh acres of wet land. It contributed every year 3.2 million MTs of paddy, two million MTs of sugarcane and 0.25 million MTs of pulses and six lakh tons of fish, 50,000 tons of prawn which was 100 percent export-oriented. “It is submitted that in the matter of release of water to Krishna Delta, time is crucial,” he added.
