HC allows formation of Wakf Boardgoverning body

Justice P. Naveen Rao of the Hyderabad High Court on Monday permitted the constitution of governing body of the Wakf Board of Andhra Pradesh. The quota meant for MLA and MLC shall be kept vacant.

The judge was dealing with a case filed by Mustafa Shaik of Guntur. The A.P. government had issued notification last August declaring that elections for members from MLA, MLC and Muthavalli categories alone will be held.

The petitioner contended that election to members from category of MP and the Bar Council was not notified. He further alleged that rules have been changed in such a way that only ruling party MLA will be elected for the governing body.

The court had granted interim stay on formation of the Wakf Board but permitted the elections to go on.

The vacate petitions were filed by government and the Wakf Board. Justice Naveen Rao said that without filling the quota meant for category MLA and MLC, the governing body can be notified and constituted.

The stay is thus vacated and case is posted for final hearing at a later date.
