‘Improper investigation can change course of a case’

Principal District and Sessions Judge Venkatesh Naik T. said here on Tuesday that if the police did not carry out a proper investigation as per law, it would change the course of a case.

He was speaking after inaugurating a workshop on “Challenges faced by the police in their daily discharge of duties” organised by the District Legal Services Authority, district administration, district police, and other organisations, at the District Police Office.

Mr. Naik said that lack of proper investigation might change the direction of the case and it might lose its seriousness. All investigation should be done within the parameters of the law. In some cases that have come up before courts, at times, there have been lapses in the collection of evidence and documentation.

The investigation officer in the case should have a thorough grasp of legal procedures so that offenders are punished. Otherwise, the offenders might get released easily. If there was any legal confusion while registering a case, the police should take the advice of the public prosecutors and judicial officers, he said.

Deputy Commissioner Priyanka Mary Francis said that the departments of police and women and child welfare were working in coordination as regards cases concerning atrocities on women. The police were working under a lot of pressure. In some cases, the offenders were themselves giving false cases. If the police investigated the cases properly, the pressure on them would be reduce, she said.

Senior Civil Judge and member-secretary of District Legal Services Authority Lata welcomed the gathering. Superintendent of Police Laxman B. Nimbargi presided over the function.

Principal Senior Civil Judge V.S. Pandit and President of Bar Association Ratnakar Shetty were present.
