The Madras High Court Bench here on Tuesday dismissed a public interest litigation petition filed by a lawyer against the demonstration to be organised by the Dravida Munnetra Kazhagam youth wing on Wednesday against frequent adjournments sought by All India Anna Dravida Munnetra Kazhagam general secretary Jayalalithaa in the disproportionate wealth case against her before a Bangalore court.
A Division Bench of Justices K. Suguna and C.S. Karnan refused to accept the petitioner's contention that the agitation would amount to interference in the administration of justice.
The Bench pointed out that a resolution passed by the DMK youth wing had stated that the agitation was against the former Chief Minister's attitude of seeking adjournments. There was no whisper about granting of adjournments or any other aspect related to court.
The judges agreed with the Additional Advocate General that the cause of action for the present case would arise only in Karnataka as the case was pending before Bangalore court.
They rejected the petitioner's argument that the PIL plea could be entertained because a part of the cause of action would arise here as the agitation was being organised in Tamil Nadu. “Further, we do not find any public interest in this petition.”
