The Madras High Court Bench at Madurai on Friday directed the Director of School Education to reserve three per cent of the Headmaster vacancies which could be filled up by promoting the Assistant Elementary Educational Officers (AEEOs).
Justice R.S. Ramanathan passed the interim direction following a batch of writ petitions filed by 65 AEEOs who claimed that the Government was trying to fill up the vacancies through a counselling on Monday without reserving any post for the petitioners.
During arguments, a Special Government Pleader contended that the petitioners could not claim reservation only on the basis of a Government Order passed by the School Education Department because the Tamil Nadu Elementary Educational Subordinate Service Rules had not been amended so far.
Replying to it, the petitioners' counsel said that they need not be made to wait until the amendment of the Rules in view of the fact that the Government had already implemented a part of the G.O. which required filling up 50 per cent of the vacancies for AEEOs through direct recruitment.
