The Madras High Court bench on Friday quashed the detention of four men under the National Security Act (NSA).
The four persons — S. Prabhu, A. Abdul, Mohammed Shalin and Shaji — were arrested by the Kanyakumari police on a charge of ‘brutally assaulting’ M.R. Gandhi, a Bharatiya Janata Party (BJP) functionary in Nagercoil in April.
The Collector had passed an order on May 21, 2013, detaining the four persons under the NSA.
The family members of the four detainees claimed that the authorities failed to follow the ‘procedural dictums’ while passing the order, and that the NSA was invoked without substantial material. A division bench quashed the detention orders on the grounds that there was a delay in considering the representations of the detainees to recall the orders.
