The Madras High Court Bench here on Wednesday granted bail to Dravida Munnetra Kazhagam (DMK) functionary V.K. Gurusamy in a case related to the murder of All India Anna Dravida Munnetra Kazhagam (AIADMK) office-bearer I. Mayil Murugan at C.M.R. Road in Munichalai here on September 25, 2013.
Justice R.S. Ramanathan passed the order on the condition that the accused should reside in Chennai and appear before Flower Bazaar police station every day until further orders.
The judge said the possibilities of the accused jumping bail, as apprehended by the prosecution, were thin in view of the fact that he was a politician.
Further, the police had already filed a final report in the case before the lower court concerned, he added.
The Inspector of Teppakulam police station here had objected to grant of bail on the grounds that “the petitioner/accused is not at all a law-abiding citizen and he is a history-sheeted rowdy element who survives due to his affiliation to a particular political party”.
The Inspector also said Gurusamy, a former zonal chairman of Madurai Municipal Corporation, his son V.K.G. Mani and their henchmen had murdered the AIADMK functionary in retaliation for the murder of his brother-in-law ‘Pambu’ Pandi by the rival group in East Marret Street here on September 23, 2013. The first murder was being investigated by Vilakuthoon police.
“This petitioner is the main brain behind the murder of Mayil Murugan. He had planned the murder along with other accused. But in order to create alibi, he got admitted to Apollo Hospitals on September 24, a day before the occurrence, and got discharged after the murder plan was executed… A history-sheet is being maintained against him at Keerathurai police station,” the Inspector said.
His written objection, filed in the court, also stated that the petitioner was an accused in about eight cases booked by Teppakulam, Avaniapuram, Keeraithurai, Central Crime Branch, Anti-Land Grabbing Cell and Tiruppur District Crime Branch police. If he was released on bail, there was every chance of the two rival groups indulging in similar crimes once again, it added.
