The Madras High Court Bench here on Wednesday dismissed a public interest litigation (PIL) petition filed by K.R. Chithan of Thevar Desiya Peravai seeking a Crime Branch-Criminal Investigation Department (CB-CID) enquiry into alleged involvement of Akshaya Trust here in organ trade.
A Division Bench of Justices V. Ramasubramanian and V.M. Velumani rejected the plea on the ground that there was no necessity for one more PIL when the court was already seized of the issue following a petition filed by C. Muthurani of All India Democratic Women’s Association (AIDWA).
“This PIL (petition) is not merely motivated by a desire to advance public cause, but also with a desire to develop the petitioner’s Peravai… When we have already seized of a petition and passed interim orders to bring inmates of the home (run by the Trust) under protective care of this court, we do not think that any other person need to show greater concern than what we have shown,” the judges said.
