The Madras High Court Bench here has closed a petition filed by a septuagenarian seeking registration of a land grabbing complaint against AIADMK MLA A.K.Bose and his son, after the government advocate submitted that the police closed the case because an inquiry revealed that the complaint was civil in nature.

Originally, T. Nallusamy (75), had moved the High Court claiming that four of his siblings and he owned a joint patta for 1.94 acres of land at Madakulam in Madurai.

A civil suit over the land between him and the children of his siblings is pending in the Madurai District Munsif Court, he had claimed.

In his petition, he had alleged that the MLA’s son, B. Sivasubramanian, had fraudulently obtained power of attorney to the land from the children of his siblings in February 2010.

He later transferred 25 cents of the fraudulently obtained land in favour of his mother B. Backialakshmi, Mr. Nallusamy had alleged.

The MLA and his son “abused him and threatened to kill him” when he questioned their action, he had added. Mr. Nallusamy had further stated that he submitted a complaint to the Commissioner of Police, Madurai City, on November 11, 2013 seeking registration of a complaint against the MLA and his son. The commissioner had forwarded the complaint to the Inspector of Police, Special Cell for Land Grabbing cases in Madurai City, but no FIR was registered, he had claimed.

The government advocate submitted that the police conducted an inquiry and the case was closed because the complaint was civil in nature.

In his order, Justice S. Vaidyanathan directed the police to furnish a copy of the closure report to the petitioner within a week to enable him take further steps in accordance with law.
