HC spares woman from going to jail

The Madras High Court Bench here has spared a woman from undergoing imprisonment for one year in a cheque bounce case after she struck a compromise with the complainant and paid Rs. 2 lakh to him in the open court.

Disposing of a revision petition filed by the woman hailing from Tirunelveli district, Justice S. Nagamuthu compounded the offence and acquitted her from the case after setting aside the conviction as well as sentence imposed by the trial court.

The judge pointed out that a Judicial Magistrate court in Tirunelveli had convicted the petitioner and sentenced her to one year of simple imprisonment. It also directed her to pay a compensation of Rs.2 lakh to the complainant or undergo three months of incarceration.

Though the woman preferred an appeal against the judgement, an Additional District and Sessions Court in the district dismissed the appeal on May 13, 2011 and confirmed the conviction and all other punishments imposed on her by the Magistrate.

Hence, she filed the present revision before the High Court challenging the confirmation of the conviction and supplemented it with a sub-application seeking the court’s permission to compound the offence since the complainant had agreed for a compromise on receipt of Rs.2 lakh.
