HC order on compassionate grounds appointment

The Madras High Court Bench here has directed the Thanjavur Collector to provide appointment on compassionate grounds to the married daughter of a deceased village assistant.

Petitioner M. Sudha had moved the court stating that her father died on March 31, 2011 while he was in service. Her father is survived by two married daughters and because her mother is aged, she applied for her father’s job. However, her application was rejected citing that the petitioner is married.

Justice D. Hariparanthaman, relying on an earlier judgment held that, “In the event of death of father or mother, the daughter cannot be discriminated in the matter of giving compassionate appointment citing marriage as a reason.”

Allowing the writ petition, he directed the Collector to appoint the petitioner in service within eight weeks.
