Madurai Bench of Madras High Court on Monday dismissed the plea of an Inspector of Narcotic Intelligence Bureau CID, facing charges possessing contraband and foisting cases, to revoke his prolonged suspension saying the nature of allegations against him were serious.
“It is not desirable to revoke the suspension order to allow the Petitioner to discharge his duty as a Police Officer during the pendency of disciplinary proceedings,” Justice K.N.Basha said, dismissing the petition of Inspector S. Gandhi.
The petitioner submitted he was under suspension from Sept 5, 2006 and there was no progress in departmental proceedings against him and hence the order of the Deputy Inspector General of Police suspending him should be revoked.
Special Government Pleader V. Rajasekaran said the inspector was facing allegation of foisting a case against a person under Narcotics drugs and Psychotropic Substance Act.
Besides, he had also been implicated in a criminal case for possessing contraband. A charge memo was issued after the suspension, and the enquiry is pending. Petitioner was arrested thereafter and released on bail.
The Judge said the petitioner, whose duty was to prevent commission of any offence, instead of registering case against the real culprits had foisted a false case against an innocent person. “Such serious allegation cannot be brushed aside and the same should be dealt with an iron hand.”
The court cannot go into the truth or falsity of the charges against the petitioner. It was open to the petitioner to defend himself before the disciplinary authority and criminal court, the Judge said.
