HC comes to rescue of engineering student

The Madras High Court Bench here has come to the rescue of an engineering student, who was caught videographing female students of his college, by ordering the Director of Technical Education (DTE) to grant approval for shifting him to another private college.

Disposing of a writ appeal filed by the student, a Division Bench of Justices V. Dhanapalan and V.M. Velumani directed the DTE to pass appropriate orders on the petitioner’s plea for transfer within a week. Though the appellant had not included the DTE as one of the respondents, the judges issued the direction at the request of appellant’s counsel R. Prabhakaran, and instructed the High Court Registry to mark a copy of their order to the DTE’s office in Chennai.

The Bench said the college at Alagarkoil had dismissed two students, including the appellant, on April 5 after they were found guilty. Disposing of his writ petition on August 27, a single judge set aside the dismissal order and directed the college management to hold a fresh enquiry and hence the writ appeal. The college constituted a enquiry committee, comprising its Principal and three Professors.

The committee recommended that he could be allowed to get transferred to some other college. The petitioner then approached a college at Sivakasi in Virudhunagar district and obtained a letter agreeing to admit him. However, since it was represented that the transfer could not be made without the DTE's prior approval, the Bench directed the Directorate to expedite the approval proceedings.
