Days after the Madras High Court’s Madurai Bench proposed contempt proceedings against Melur Judicial Magistrate K.V. Mahendra Boopathy after “smelling a rat” in the way he handled illegal granite quarry cases, the judicial officer on Tuesday acquitted PRP Granites, a leading mining company, and another firm, but ordered criminal prosecution against former Madurai Collector Anshul Mishra and two Special Public Prosecutors (SPPs) for “suppressing facts.”
In his order accusing the prosecution of having brought disrepute to him by suppressing crucial facts before the High Court Bench, the Magistrate quoted the Sanskrit sloka ‘ Buddhir Balam Yasho Dhairiyam ,’ and said he (magistrate), who had been rendering judicial service with his “intelligence, strength and courage,” must punish the prosecution for its “blatant lies and procedural lapses.”
He stated that the High Court had criticised him on Thursday only because of the prosecution’s failure to bring to its notice that he had passed certain orders in another batch of granite mining cases.
Criminal prosecution against former Madurai Collector Anshul Mishra and two SPPs ordered
