Durai Dayanithi moves HC

Former Union Minister M.K. Alagiri’s son Durai alias Dayanithi (27) has moved the Madras High Court Bench here to relax conditions imposed by the court while granting him anticipatory bail in a criminal case registered against him by the Madurai district police in connection with the multi-crore granite quarry scam.

In his petition, Mr. Dayanithi recalled that he was granted advance bail on December 10, 2012,on condition that he should surrender his passport before a Judicial Magistrate at Melur near here. In April 2013, the court modified the condition and directed the Magistrate to return the passport after obtaining a bond for Rs. 2 lakh.

While modifying the order, the court made it clear that the petitioner should inform the Magistrate about his travel plans to foreign countries at least 10 days before departure and also serve a copy of the information to the investigating officer. Subsequently, he obtained the passport and visited Europe between August 5 and August 30, 2013.

On November 22, 2013, the High Court relaxed the condition further and ordered that it was enough if the petitioner informed the Magistrate about his travel plans three days prior to departure. Now, urging the court to dispense with the requirement of informing the Magistrate, the petitioner said that the condition was causing “serious prejudice” to him.

“The petitioner, being a movie producer, has to be sure of his travel plans including the pre-production schedule abroad for shooting along with the star cast and crew… Further, he hails from a respectable family and he is the son of a former Union Cabinet Minister. He is innocent and has not committed any offence as alleged by the prosecution,” he said in his petition.
