Shukkoor murder: HC stays directive for CBI probe

: A Division Bench of the Kerala High Court on Monday stayed until further orders a single judge’s verdict ordering a CBI probe in a 2012 case relating to the murder of Abdul Shukkoor, an Indian Union Muslim League activist in Kannur district, in which CPI(M) leaders P. Jayarajan and T.V. Rajesh, MLA, are arraigned as accused.

The Bench comprising Acting Chief Justice Thottathil B. Radhakrishnan and Justice Anu Sivaraman issued the stay order on an appeal filed by Mr. Jayarajan and Mr. Rajesh. According to the appeal, there was no material before the single judge to conclude that the investigation was not being done in a proper manner by the State police. Besides, no case diary had been made available to the court.

The document before the single judge was a truncated final report. They pointed out that the case did not come under the category of rarest of rare cases, warranting a CBI probe.

The single judge had passed the verdict while allowing a writ petition filed by the mother of Shukkoor, A.C. Aathikka. Shukkoor, an activist of the IUML was murdered allegedly by CPI(M) activists at Keezhara in Kannur in February, 2012.
