The Kerala High Court on Friday stressed the need for providing subsidy in time to consumers who had installed solar projects under the Jawaharlal Nehru National Solar Mission of the Central government.
Justice Thottathil B. Radhakrishnan observed that that Centre and State governments would have to pay subsidy when they made the offer and the people proceed to accept the solar projects.
The government machinery should ensure that subsidy reached the consumers on time. The court made the observations while dealing with a petition filed by the district purchase manager of the Agency for Non-Conventional Energy and Rural Technology (ANERT), Wayanad, against the State consumer forum’s directive to provide subsidy to a consumer.
The court said that when the Centre had failed to provide subsidy, the consumer was entitled to legal remedy through consumer forums. The court held that the district purchase manger was not personally liable to pay the subsidy.
