Hearing on LEAF’s appeal adjourned

A Division Bench of the Kerala High Court on Friday adjourned to June 28 the hearing on an appeal filed by the Lawyers Environmental Awareness Forum (LEAF), the green wing of the Kerala High Court Advocates’ Association, against a single judge’s stay on the order of the National Green Tribunal, Kochi Circuit Bench.

It had banned diesel vehicles over ten years in six cities in the State and restrained the government from registering new diesel vehicles of 2000 cc and above.

The single judge passed the stay order on writ petitions filed by the KSRTC and others.

In its petition, LEAF contended that the single judge had erred in entertaining the writ petitions challenging the tribunal’s order as Section 22 of the National Green Tribunal Act had excluded the jurisdiction of the High Court under Article 226 and 227 of the Constitution.

As per the Section, an appeal against the orders of the tribunal could be filed only in the Supreme Court.
