High Court flays CBI stand

The Kerala High Court on Monday criticised the CBI for its reluctance to take up the probe into the Abdul Shukkoor murder case.

Justice B. Kemal Pasha while ordering a CBI probe into the murder case observed that the CBI could not wash its hands of by saying that it could not take up the investigation as it had been flooded with similar investigations.

The court said that in a particular locality of the State, when a proper investigation was not possible by the State police, the State could seek the aid of the Centre in getting the matter investigated by the CBI. In the federal system, it was for the Centre government to “digest” such a situation and “rise to the occasion by handing over the investigation to the CBI.”

The court said that when the conscience of the court was shaken and the cries of the bereaved mother of the deceased were echoing in the ears of the court, the court had to order a further investigation by the CBI.

The Kerala High Court directed the State government to provide all assistance, including necessary infrastructure.
