The Kerala High Court has directed the Central Board of Secondary Education (CBSE) to take appropriate steps to ensure that the Board’s directive to reinstate a music teacher, who was terminated from service, in Choice School, Tripunithura, was complied with.
Justice S. Siri Jagan issued the directive on a writ petition filed by Salim M. Prabhaker challenging his termination from service.
The court made it clear that if the school management did not comply with the order, appropriate steps should be taken against the management as per the affiliation bylaws, if necessary, by withdrawing the affiliation granted to the school for non-compliance with the order of the CBSE.
The court also said that it would be open to the school management to seek its remedies against the CBSE order appropriately.
The school management took the stand that the CBSE had no power to issue a directive for the reinstatement of a teacher dismissed from service.
