A local court has convicted a vegetable vendor and sentenced him to undergo 10 years’ rigorous imprisonment in connection with a culpable homicide case. The court also imposed a fine of Rs. 5,000 and if the accused fails to pay the fine, he has to undergo two months’ simple imprisonment
The second Additional Metropolitan Sessions Judge, D. Dharma Rao, held the vegetable vendor Abdul Aziz guilty and pronounced the judgement. Additional Public Prosecutor S. Gopal Singh said the victim Sheik Nizam, a keymaker in Patel Nagar in Begum Bazar, died after his brother-in-law Aziz attacked him with a knife in August 2009.
Aziz fled the spot after committing the offence. The police first booked a murder case under Section 302 (murder) of IPC and later altered it to Section 304(II) (culpable homicide not amounting to murder) as the accused had committed the crime after a heated argument with Nizam.
Nizam had asked Aziz to find out a suitable job to eke out his livelihood instead of staying at his house with two daughters.
Angered over this, Aziz brought a knife from the kitchen and attacked Nizam resulting in grievous injuries on chest. He died on the spot. Evidence given by the victim’s wife, mother and brother enabled them to prove Aziz guilty, Mr. Singh said.
Seven-year imprisonment
In a separate case, the 5 Metropolitan Sessions Judge sentenced an autorickshaw driver Bhanvir Singh to imprisonment of seven years for driving his wife Neha to end her life at their house at Chikkadpally. Unable to bear Singh’s torture, Neha committed suicide by setting herself ablaze in January 2008. If Singh fails to pay Rs.1,000 fine amount, he has to undergo additional six months’ imprisonment, the court ordered.
