A vacation bench of the High Court of Andhra Pradesh comprising Justice R. Subhash Reddy and Justice M. Satyanarayana Murthy on Thursday stayed the operation of the judgement delivered by a single judge who had struck down a rule pertaining to PG medical admissions.
The judge struck down clause II (viii) of the rules that permitted reserving certain seats to categories of BC-A, BC-D women from the common pool category. Pooling together the residuary seats to be filled by BC candidates did not amount to creating a new class within the BC category, said the judge.
The State Government filed appeal and contended that the Supreme Court judgment in Ritesh Shas case is not applicable to PG seats but applies to MBBS and BDS seats only. The bench admitted the appeals and stayed the order of single judge.
Meanwhile, the same bench said appeals filed challenging the fresh PGMET would be heard after vacation.
It may be recalled that several students filed writ petitions challenging the decision of State Government to hold fresh entrance examination as the paper was leaked. The single judge upheld the decision of Government and the present appeal was filed challenging the order of single judge. Now the appeal will be heard after June first week.
