Rules framed for compensation under new LA Act

In most cases amounts to paid to displaced persons higher than provisioned in Central Act

The State government has decided to pay compensation of ₹5.04 lakh (equivalent to that of a house under the two bedroom housing policy) each for families living together that will be displaced for major projects.

The payment for single family will be ₹1.25 lakh (equivalent to that of Indira Awas Yojana). The government had released set of guidelines of The Telangana State Land Acquisition (Consent Award, Voluntary Acquisition and Lump-sum Payment towards Rehabilitation and Resettlement) Rules, 2017. The rules had been issued as part of the amendment made to the Central Land Acquisition Act recently to suit the requirements of the State.

The affected families would be offered one-time payment of ₹5 lakh under the choice of annuity or employment or annuity of ₹3,000 a month for 20 years for the families belonging to SC/ST communities and ₹2,500 a month in case of others.

Subsistence grant

In addition, subsistence grant of ₹ 40,000 for one year would be paid to the affected families which is higher than ₹3,000 per month offered under the Central Act. The SC/ST families would receive an additional ₹ 60,000 as one time grant while ₹ 50,000 was offered under the Central Act.

The affected families would now be paid ₹ 60,000 as one time transport grant in addition to another ₹ 25,000 as one-time financial assistance for families having cattle or petty shop enabling them to set up cattle shed or petty shop as the case may be. For artisans, small traders and others owning non-agricultural land or commercial/industrial institutional structure in the affected area, a one-time grant of ₹30,000 had been notified.

Stamp duty

The affected families would also be given ₹60,000 as one-time resettlement assistance while the Government had directed the officials concerned to ensure that stamp duty, registration and other fee payable for registration of the land or house allotted to the families was borne by the procuring agency. Steps should be taken to ensure that the land or house allotted to the affected families would be free from all encumbrances.

The Government had also notified one-time lump sum assistance to a joint family that decides to set up a self-financed scheme or an enterprise based on their choice or for any other income generating activity. Families opting for this would be provided lump sum of ₹7.5 lakh.
