Lapse of ordinance on land acquisition to be analysed: HC

A Division bench of the Hyderabad High Court comprising Acting Chief Justice Dilip B. Bhosale and Justice P. Naveen Rao on Tuesday ruled that the issue of exempting the process of acquisition for the capital of AP from several provisions of Land Acquisition Act of 2013 needed a through examination.

The bench was hearing the cases filed by Jaya Rao and others of Guntur district. They contended that in May 2015, a GO was issued declaring that there was no need to conduct Social Impact Assessment (SIA) etc., in view of ordinance issued by the Central government amending the act of 2013.

It may be recalled that the Central Government exempted certain projects form vigorous checks and balances of the 2013 Land Acquisition Act.

The petitioners contended that the exemption was not applicable to the capital area activity and after the ordinance had lapsed and not renewed by the Central Government, the GO of 2015 was to be set aside.

The bench said that the effect of lapse of the ordinance on the ongoing land acquisition process was to be analysed and adjourned the case to Monday.
