Issue public notification on regularising house sites: High Court

A division Bench of Hyderabad High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Monday asked the Chief Secretary of Telangana State to take steps to issue public notification as directed by the court on earlier occasion regarding the pendency of the case filed challenging the decision of the government to regularise house sites under encroachment.

The Bench was dealing with the cases filed by Prof. P. L. Visveswar Rao and others challenging the GOs 58 and 59. They contended that the government had issued GOs 58 and 59 to regularise the encroachments without evolving mechanism to impose penalty and check misuse. They lamented that such large-scale regularisation is against public policy.

The Bench directed the government to file counter affidavit and made it clear that this regularisation will be subject to orders in the writ petition.

The Bench wanted the State government to issue public notice to inform every one that any regularisation will be subject to judgment. On Monday, the Bench wanted the government to confirm about the publication. When there was no specific response in affirmative, the Bench expressed displeasure at this. The Chief Secretary was asked to take steps to issue such notification. The case is adjourned by two weeks.
