High Court warns official

A division bench of Hyderabad High Court on Friday warned of summoning an officer and declaring him to be incompetent to the post for failure to implement court order.

The bench comprising Chief Justice Kalyan Jyoti Sengupta and Justice PV Sanjay Kumar said this while dealing with a contempt case with regard to filling up the post of chairman of the National Council of Rural Institute.

In December last year, the court directed the Secretary of Ministry of Human Resource Development and others to fill up the post within six weeks and consider sanctioning regular post in pursuance of the proposal sent by the National Council of Rural Institute during the period. Upon failure to implement the said order, the court suo motu initiated contempt proceedings in the case.

When the matter came up for hearing on Friday, the Assistant Solicitor General of India sought more time for implementation of the court orders.

Reacting to this, the bench said that the authorities concerned had shown negligence to appoint a chairman for the institute which was meant to propagate Gandhian philosophy. It seems that the issue will be resolved only if the salaries of the concerned officials are stopped instead of sending them to jail for wilfully disobeying the court orders. While posting the matter to March 19 next year, the bench warned of issuing notices in the contempt case.
