High Court allows framing of charges against Tech Mahindra

A division Bench of Hyderabad High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Wednesday permitted the Special Court to continue with process of framing charges against Tech Mahindra in criminal case initiated by Enforcement Directorate.

The Bench directed Tech Mahindra Limited, (formerly known as Satyam Computer Services Limited) to appear before the trial court. The Bench was passing these interim orders by suspending order of single judge who had declared that Enforcement Directorate cannot proceeded against Tech Mahindra in Satyam Computer scam case. The Enforcement Directorate registered a case against 213 accused including the main company.

Tech Mahindra approached the High Court contending that they could not have been shown as accused as this company was not in existence when the alleged crime of money laundering had taken place. The Enforcement Directorate filed the present appeal challenging the orders of the single judge. The bench said that the process of framing the charges can go on. The appeal is adjourned for further hearing after April 20.
