Justice M.S. Ramachandra Rao of the Hyderabad High Court on Monday admitted a writ petition filed by employees of Tech Mahindra, who were recently retrenched from service. He was dealing with a case filed by Sudhakar and three others who complained to the court that the management was resorting to coercion, forcing the employees to resign. The petitioners told the court that they had approached the Joint Commissioner of Labour, Ranga Reddy, complaining against such high-handed illegal methods being adopted by the company to get rid of their services. The JCL had initiated conciliation proceedings to resolve this issue, and then the company had given them termination letters.
This was in violation of Sec 47(2) of Shops and Establishments Act. The earlier orders issued by the State Government exempting IT companies from Shops and Establishment act was already suspended by this court. The petitioners sought a direction to the JCL to take steps for their reinstatement.
The judge ordered notices to Principal Secretary, Labour and Employment Department, Government of Telangana, Joint Commissioner of Labour, Ranga Reddy and Tech Mahindra company and granted three weeks to respond to the issues raised in the writ petition.
