A court on Thursday refused permission to CBI to shift K. Mehfuz Ali Khan, personal assistant of former Karnataka Minister Gali Janardhan Reddy, here to face trial in Obulapuram Mining Company (OMC) scandal.
Khan is presently lodged in Bangalore central jail following his surrender in a court there in the case against Associated Mining Company (AMC).
Both, OMC and AMC were owned by Mr. Janardhan Reddy.
While rejecting permission to CBI to bring Khan here, the court allowed a memo filed by the investigating agency to include him as an accused in the OMC case.
The issue of prisoner's transit warrant to bring Khan from Bangalore jail was denied to CBI on the ground that its request did not meet any of the conditions laid down by criminal procedure code for the purpose.
Neither was he required to answer charge of an offence nor face any proceedings nor stand witness in any case.
The court had not taken cognizance of any offences against Khan in order to initiate proceedings against him, it said.
