Unauthorised constructions liable for penal action which includes levy of penalty
The Greater Hyderabad Municipal Corporation (GHMC) has announced that melas would be held in all the 18 circle offices from December 22 to 31 including holidays for clearing pending Building Penalisation Scheme (BPS) applications and at the five zonal offices for processing Layout Regularisation Scheme (LRS) applications.
The BPS scheme had come to a close more than a couple of years ago and as such no fresh applications for regularising buildings constructed in deviation of the sanctioned plans would be entertained. From January1, 2008 till its closure, 2,05,023 applications were received of which 1,36,716 applications were approved and regularisation orders issued.
About 27,860 eligible BPS applications were awaiting clearance for want of payment of balance penal fees and submission of required documents to the GHMC by the owners.
Commissioner M.T. Krishna Babu urged the citizens to avail the opportunity and complete the regularisation process.
Unauthorised constructions were liable for penal action and it includes levying a penalty of 25 per cent on property tax till the unauthorised construction was demolished or regulated.
For regularising illegal plots under LRS, he said that only unapproved layouts and sub-division of plots with registered sale deed/title deed existing prior to the date of notification of LRS would be considered.
Applicants should submit copies of the sale deed/title deed. Agreement of sale or the general power of attorney shall not be considered as evidence. The GHMC had so far received 94,752 LRS applications of which 46,085 applications were approved.
Around 21,172 applications were pending for payment of balance penal amount. A 20 per cent surcharge on the penal amount was being levied on all pending applications on the balance penal amount and a further 20 per cent on forms received after December 31, 2011.
The cut-off date of January 21, 2008 of site registration to be eligible for LRS stands good, he added.
