The Delhi High Court on Monday declined to grant the interim relief of common election symbol for MCD polls to Yogendra Yadav-led Swaraj India saying it cannot ignore "the practical and functional difficulties".
"We cannot ignore the practical and functional problems which would arise. These would hinder and create obstruction in the conduct of free and fair election in a smooth manner," said a Bench headed by Justices Sanheev Khanna and Chandra Shekhar.
The Bench was of the view that if interim relief is granted at this stage, "many others would join the bandwagon and would have grim consequences."
Swaraj India had moved court in appeal against the March 29 single judge order by which it was denied common symbol for MCD polls.
The single judge had held that with the provision of photograph of the candidate on EVMs, no prejudice would be caused to the party due to lack of common symbol.
The party had urged the Delhi poll panel and the judge that a common symbol be allotted to registered unrecognised parties to create a level playing field.
While denying the interim relief, the division Bench has fixed the appeal for further hearing on July 19.
