Police pulled up for being ‘evasive’ in gang-rape case

The Delhi High Court on Friday pulled up the Delhi Police for being “evasive” on providing details of the officers who were on duty on the route on which the 23-year-old physiotherapy student was gang-raped last Sunday.

A Division Bench of Chief Justice Darmar Murugesan and Justice Rajiv Sahai Endlaw took the police to task after going through a status report filed in a sealed cover jointly by the city police and the Delhi Government on the progress of investigation into the crime and providing medical treatment to the victim and equipment and qualified personnel to the forensic laboratory where the investigating agency would send material concerning the case for test.

“We have gone through the report and we are not convinced. None of the details of the police officers have been mentioned,” the Bench said.

The police filed the status report in response to a Court direction by the Bench on Wednesday. The Court had passed the direction taking suo motu note of the outrageous incident.

The Court had asked the police to give details of the police personnel who were on duty during those 40 minutes during which the culprits sexually assaulted the woman on the route between Munirka and Mahipalpur flyover.

Best medical treatment

Counsel for the Delhi Government, Najmi Waziri, submitted that the Government was committed to provide best medical treatment to the victim and would follow advises of the doctors treating her on the course of treatment in the days to come.

Mr. Waziri also submitted that the Government would ensure availability of qualified personnel and all the required equipment at the forensic laboratory to conduct the test of incriminating materials concerning the case.

The Bench had on Wednesday directed that there should be no delay in conducting the forensic test in the case.

The Bench later asked the police to file a detailed affidavit on the police personnel on duty on the route by January 9, the next date of hearing.

It also directed the investigating agency to inform it on the next date of hearing about the guidelines they had framed to prevent recurrence of such incidents in future.

During the hearing, advocate Meira Bhatia and another woman lawyer assisting the Court in the matter complained that the victim was not getting proper treatment at Safdarjung Hospital, therefore, she should be shifted to a super speciality hospital for a better treatment. But the Court refused to pass any direction on it.
