Nursery admissions in a bind, once again

The tug of war between different lobbies of parents continues to plague the nursery admission in the Capital with the Delhi High Court on Wednesday putting on hold the fresh draw of lots as earlier directed by its Single Bench on March 6.

A Division Bench of Justice B.D. Ahmed and Justice Siddharth Mridul ordered stay of the fresh draw of lots on a petition by a group of parents whose wards have made it to the cut off list on the basis of 70-points scheme.

The Bench also made it clear that till March 24, the next date of hearing, no admission shall take place at schools where draw of lots have already been conducted following the March 6 order.

Counsel for the petitioners urged the Court to protect their rights and argued that for no faults of theirs, they would have to undergo the process once again after their kids were chosen for admissions.

The fresh petitioners filed an appeal against the Single Bench order of March 6 which had scrapped the earlier draw of lots and ordered a new one on a petition by another group of parents whose wards exited from the merit after the scrapping of the rule of grant of 5 points to them under the head of the transferred applicants.

The Delhi Government had on February 27 scrapped the rule. It had done so after several parents moved the High Court challenging grant of the points in the admissions to the children belonging to the transferred category.

The Government had issued the notification scrapping the rule after the High Court asked it to take a decision regarding the inter-State category in nursery admissions and come out with a fresh schedule for draw of lots by February 27.

The notification also said that if a school had conducted draw of lots for those kids who secured 70 points, it shall remain valid for the selected kid. Fresh draw of lots shall be held for the remaining applicants having 70 points, including wait-listed applicants and those applicants who had earlier secured 5 points under the inter-State transfer head, the February 27 order had said.

The Single Bench order for a fresh draw of lots had come on the petition against this order.
