Fearing a possible repeat of the recent judgment of the Supreme Court quashing the acquisition of land in Shahberi Village in the case of land acquisition in other parts of Noida Extension as well, the Noida Extension Flat-Buyers Welfare Association (NEFBWA) has sent out a plea demanding that their interest also be considered before any verdict is passed.
The Association stated this while referring to the new writ petitions being filed by farmers of adjoining villages who have approached the Allahabad High Court challenging the acquisition of their land on the grounds that their land too was acquired through the same procedure as followed in Shahberi Village.
According to NEFBWA, the facts that must be considered at this stage include the huge amount of development that has already taken place in the area prior to the filing of these writ petitions and the shortage of affordable dwelling units in the National Capital Region.
NEFBWA treasurer Rahul Sharma said: “Noida Extension is a well-planned and well-developed modern township. About one lakh flat buyers have already invested here and hundreds of crore of rupees have been paid as stamp duty for execution of the lease deed. Moreover, construction work has already started in most of the projects and in some projects the building has come up to the eighth floor. Displacement of about one lakh flat buyers would further add to the already acute housing shortage in NCR.”
“While we support the fact that genuine grievances of the farmers should be addressed, we also demand that facts from our side also be considered before a final decision is taken in the matter. In fact, our Association has been formed with this very objective in mind of presenting our case before the Allahabad High Court that these bona fide flat buyers would suffer huge and irreparable losses on account of any hard decision in post-Shahberi cases,” he added.

Earlier this month, the Supreme Court had upheld the Allahabad High Court's decision to quash 156 hectares of land in Sahberi village in Noida Extension, a part of Greater Noida, acquired from farmers by the local development authority.
Last week, real estate developers, including Amrapali and Supertech, had promised that they would either shift the buyers affected by the order to other projects or return their money with interest.
