Motor tribunal grants relief in accident case

Family of deceased gets ₹17.8 lakh

A Motor Accident Claims Tribunal (MACT) has awarded a compensation of ₹17.8 lakh to the family of a 36-year-old man who was killed in an accident near Noida in 2014.

Presiding Officer Rajeev Bansal directed Oriental Insurance Company Limited, with which the offending vehicle was insured, to pay the amount to the wife, son and parents of Deepak Aggarwal.

Bank details

“Considering the financial needs of claimants Koshila Devi and Karu Ageri, the parents of the deceased are awarded a compensation of ₹2 lakh each. They will provide their bank details within three weeks where they want this compensation credited,” Mr. Bansal said.

“Of this, ₹1 lakh each shall be immediately released to them and the balance amount of ₹1 lakh shall be kept in 20 FDRs of ₹5,000 each for a period of six month to 26 months in their respective accounts,” Mr. Bansal said.

Minor son

“A sum of ₹4 lakh is awarded in favour of Vicky, claimant no. 2, that is, the minor son of the deceased. This amount shall be kept in FDR till the time he attains the age of majority. The balance amount shall be payable to petitioner, Promila, the wife of the deceased. Her share will be ₹9,80,000 plus interest as per this award,” the presiding officer ordered.

Truck had hit cycle

The truck had hit Mr. Aggarwal while he was travelling on his cycle. He fell due to the impact and was taken to Lok Nayak Hospital, where he died two weeks later. The family of the victim had sought compensation of ₹1 crore.

The tribunal relied on the post-mortem report, mechanical inspection report of the vehicle and the charge-sheet filed by the police to decide the compensation in favour of the victim’s family.
