A Delhi court has convicted a man for attempting to cheat a woman and the Delhi Development Authority by seeking conversion of her property in West Delhi’s Paschim Vihar in his name on the basis of forged documents and faking her signature on the no objection certificate in 1994.
The Kotla Mubarakpur police had registered the case in March 1998 on a complaint by the DDA. Verification of documents submitted by accused Trilok Singh revealed they were forged. Forensic examination of land owner Meena Gupta's specimen signature proved Singh had forged her signature on the NOC.
The court dismissed a plea by Singh that he was a victim of cheating by one Mukesh Kumar, who allegedly sold him the land, as the accused failed to prove the mode of payment for the same to Mr. Kumar. The court also dismissed an argument by his counsel that Ms. Gupta had not filed any complaint as sufferer of wrongful loss, saying the argument had no force as she was cited as the victim in the DDA complaint.
“The offence of use of forged document under Section 471 and attempt to cheat for the purpose delivery of the property under Section 420 read with section 511 [punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment] of the IPC stands proved,” the Metropolitan Magistrate said while convicting the accused.
