AAP MLA granted bail in a molestation case on Wednesday after two dismissed pleas

A Delhi court has granted bail to the AAP’s Sangam Vihar MLA, Dinesh Mohaniya, in a molestation case saying that “no purpose would be served by keeping him in judicial custody anymore”.

Additional Sessions Judge Neelam Singh of the Saket District courts granted him bail on Wednesday on furnishing a personal bond of Rs. 50,000 with a surety of a like amount.

“Since the investigation is almost complete and the fact that the accused is in judicial custody since June 25, therefore, no purpose would be served by keeping him in judicial custody anymore,” the Judge said.

Opposing the bail application, Additional Public Prosecutor in the case submitted that there were chances that the MLA, who is an influential person, may tamper with evidence and win over the witnesses if granted on bail.

‘Will abide by conditions’

Counsel for the MLA, H.S. Phoolka, countered the apprehensions of the prosecutor by submitting that his client was ready to abide by all the conditions imposed by the court and was ready to give an undertaking that he would not interfere with the investigation and prosecution evidence.

Mr. Phoolka further submitted that the MLA was no more required in judicial custody as the investigation was over.

Earlier, two different Metropolitan Magistrate (MM) courts had refused to grant bail to the MLA.

A Duty Magistrate court had on June 25 dismissed his bail application observing that “the statement of the complainant recorded under Section 164 of the Criminal Procedure Code contained serious allegations”.

Later, another MM court on June 27 dismissed his bail plea saying: “there is no change in circumstances since his first bail application was dismissed on June 25”.

The Delhi Police had arrested the MLA during a press conference on June 25 for allegedly molesting and assaulting a woman.
