Insurance firm told to pay ₹5.8 lakh

Company disputed complainant’s claim

The National Consumer Disputes Redressal Commission (NCDRC) has directed Bajaj Allianz General Insurance company to pay a policy holder ₹5.87 lakh for his vehicle, which was involved in an accident.

The complainant, Bant Singh, had alleged that his vehicle, which was insured by the company, was totalled in an accident. He further alleged that the insurance company initially agreed to pay the entire amount needed for the repair, but later repudiated the claim.

“It is stated that at one point, the firm agreed to pay the claim, but later sent a letter repudiating the claim, saying that the vehicle was not under the possession and control of the complainant and that he had no financial interest in the vehicle,” read the order.

The insurance company contested the claim stating that the complainant was only a ‘dummy registered owner’ and that the vehicle was not being driven by him at the time of the accident.

Arguments rejected

The consumer forum, however, dismissed the firm’s arguments stating: “Even if the vehicle was being driven by somebody else, Bant Singh is entitled to get claim and he does fall within the definition of ‘consumer’.

Moreover, there is no evidence on record to substantiate the version of the insurance company that the said vehicle was being used for commercial purposes.”

The NCDRC directed the insurance company to refund the money within eight weeks.
