Laying emphasis on maintaining high academic standards, the Delhi High Court has dismissed a Central government employee's writ petition seeking a direction to Delhi University to allow him to complete his law degree course by letting him appear in the back papers beyond the span period.
Justice Manmohan of the High Court rejected the petition of Avadhesh Kumar last week, while observing that the education standards could not be allowed to fall to an “absolutely low level”. The court said the petitioner's plea that non-completion of the course was due to circumstances beyond his control was factually incorrect.
“Every country has to try to achieve excellence and the highest academic standards. A society that tolerates too much of incompetency can never prosper,” said the court in its judgment.
Mr. Kumar said he was required to complete his LL.B. course by 2014 within the prescribed span period but he could not complete it on time as, being a Central government employee, he was transferred from one place to another.
The petitioner's counsel contended that he could not complete the course due to circumstances beyond his control, while the university had been granting chances to students to complete it beyond their stipulated span period.
The counsel said that petitioner had availed all the attempts and appeared in all the examinations during the regular course as well as the span period. The court noted that though the law course was to be completed within three years, Mr. Kumar had availed the span period of six years.
