The Delhi High Court has pulled up the Delhi Police for its failure to file a charge sheet on time in a murder case, which led to the release of two accused persons on bail. The Court observed that the failure to file charge sheet had reflected the “insensitiveness and callous approach” of the police.
Justice V.P. Vaish of the High Court said the Station House Officer of Kanjhawala police station in North-West Delhi had failed to supervise investigation in the case involving the murder of an 80-year-old.
“It is needless to mention here that the SHO is the Chief Investigating Officer of a police station and it is his primary duty to supervise the investigation and ensure that at least in serious offences like murder etc., investigation is completed at the earliest,” said the Court in its order rejecting anticipatory bail to two other persons in the case over the weekend.
The Court said an accused should not get benefit of statutory bail due to default on the part of the investigating agency.
The Judge directed the Police Commissioner to hold departmental inquiry against the SHO concerned as well as the Investigating Officer within a period of four weeks and submit a report in this regard before the Court by December 23.
